Terms of Service

1. Parties

MybeautyAi / MyBeautyAI is operated by MY BEAUTY AI LIMITED.

These Terms of Service (“Terms”) are an agreement between you and MY BEAUTY AI LIMITED (trading names: MybeautyAi, MyBeautyAI; also referred to as “we”, “us”, or “the Company”), governing your use of https://mybeautyai.app and related SaaS products.

2. Services

MyBeautyAI provides beauty salon operations management software, including but not limited to client management, appointments, sales and packages, redemptions, inventory, staff rostering / payroll tools, reporting, and WhatsApp AI / messaging-related features (subject to your subscription and settings). We may update, add, or adjust features from time to time.

3. Accounts and eligibility

You must provide true and accurate registration information and are responsible for activity under your account. You confirm that you are authorised to accept these Terms on behalf of your salon or company. You must not use the account for unlawful, fraudulent, or rights-infringing purposes.

4. Customer data and responsibility

Client, staff, and other business data that you enter or collect through the platform (“Customer Data”) remains owned by you and is your responsibility. You warrant that you have obtained any required consents or have another lawful basis to process such data, and that you comply with applicable privacy and communications laws (including WhatsApp / messaging rules).

We process Customer Data on your instructions to provide the service. See our Privacy Policy for details.

5. Acceptable use

You must not:

  • Abuse, interfere with, or attempt unauthorised access to the system
  • Send spam, fraudulent messages, or content that violates Meta / WhatsApp policies
  • Upload malware or content that infringes intellectual property rights
  • Resell the service (unless separately agreed in writing) or misrepresent your relationship with us

6. Fees and subscriptions

Some features require a paid subscription or usage-based billing (for example, Wallet). Fees, trial periods, and billing terms are as published on the website or shown in account billing settings. Except where required by law or agreed by us in writing, fees paid are generally non-refundable. Late payment may result in limited functionality or account suspension.

7. Third-party services

The service may integrate third parties (for example, payment, cloud, and WhatsApp / Meta APIs). Those services are subject to their own terms. We will provide reasonable assistance in the event of third-party interruptions or policy changes, but we do not guarantee continuous availability of third-party services.

8. Intellectual property

The platform software, interfaces, trademarks (including MyBeautyAI), and related content belong to us or our licensors. We grant you a limited, non-exclusive, non-transferable right to use the service for your internal business operations. Rights in Customer Data remain with you.

9. Disclaimer

The service is provided on an “as is” and “as available” basis. To the extent permitted by law, we do not warrant that the service will be uninterrupted, error-free, or fit for a particular purpose. AI replies are assistive only; you remain responsible for final decisions and external communications.

10. Limitation of liability

To the extent permitted by law, we are not liable for indirect, incidental, special, or consequential loss arising from use of or inability to use the service. Our total liability under these Terms is limited to the fees you actually paid us for the relevant service in the twelve months before the claim (or HK$1,000 if no fees were paid), except where liability cannot be excluded by law.

11. Termination

You may stop using the service at any time and close your account through the product flow. We may suspend or terminate access if you seriously or persistently breach these Terms. After termination, we may retain or delete data in accordance with the Privacy Policy and legal requirements.

12. Governing law

These Terms are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region of the People’s Republic of China. The parties submit to the non-exclusive jurisdiction of the courts of Hong Kong.
